In general, these characteristics include the dimensions, weight, quantity, colours and composition of goods available. These characteristics appear to support the photograph illustrating the offer. The consumer recognises that the photograph of the product that appears on the website is indicative only.

The products presented on the site are in accordance with French legislation and standards applicable in France. Unless otherwise stated, the company maisondelgusto.com does not limit geographically the offer.

The client is aware that the goods will be delivered by postal services.

ARTICLE 4 - Terms and Conditions

All prices are quoted in euro and are inclusive of all taxes including VAT, but excluding costs of delivery.

Delivery charges are shown when viewing your basket on top, when choosing the delivery date and, finally, before you confirm your order for the payment process.

The sale price can be changed at any time by maisondelgusto.com but we will apply the rates that were displayed at the time of your order.

ARTICLE 6 - Conclusion of the online contract

An order can be done on the website maisondelgusto.com (www.maisondelgusto.com).

For each order of Products through the Site, you will be requested to confirm your acceptance of the Terms applicable on the date of the order. After placing an order of Products, you will receive an e-mail from Maison del Gusto acknowledging that Maison del Gusto has received your order of Products. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by Maison del Gusto, and Maison del Gusto will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (“Shipping Confirmation”). The contract between you and Maison del Gusto (“Contract”) will only be formed when Maison del Gusto send you the Confirmation. The Contract will relate only to those Products whose dispatch Maison del Gusto has confirmed in the Confirmation. Maison del Gusto will not be obliged to supply any other Products which may have been part of your order until the Confirmation of such Products has been confirmed in the Confirmation.

ARTICLE 7 - Payment

To set the order, the customer has the choice of the following payment options: Carte Bleue, Visa, Mastercard, American Express.

For payment by credit card, the debit is made at the time of the shipment of the order provided that we have obtained prior permission to debit your account with appropriate payment center, failing which the order could not be taken into account.

The payment order may be revoked in case of misuse of the card in accordance with the agreement between the customer and his bank.

Maison del Gusto adress site HTTPS (Hyper Text Transfer Protocol Secure), allows secure ecommerce transactions. All banking information are not progressed and retained in any way from Maison del Gusto. All transactions are automatically and directly processed on the bank secure site. Online payment by credit card is done in a secure environment via the security system "Secure Sockets Layer", which allows for encrypting your banking information when transmitted over the network.

ARTICLE 8 - Right and withdrawal period

maisondelgusto.com means that any customer who is not satisfied with the products ordered on the website can exercise his right of withdrawal under the best conditions.

The customer returning the product within that period shall have the right to exchange or refund the price of product ordered and reimbursement of shipping costs. The shipping costs for returned products remain the responsibility of the customer. The products must be returned in perfect condition for resale in their original state (packaging, accessories, instructions ...) and duly sealed to “Le Soleil d’Or” 7-9 Rue Aureglia, 98000 Monaco. You have a legal obligation to take personal care of the Products while they are in your possession.

The right of withdrawal cannot be exercised for fresh products (forwarding difficulties, risk of deterioration and rapid expiration).

Maison del Gusto will not be responsible or liable if any Product you wish to return is delivered late or lost. In addition, Maison del Gusto has sole discretion in determining whether the Products are in original condition when returned to Maison del Gusto.

ARTICLE 9 - Repayment Terms

In case of exercise of right of withdrawal, the company maisondelgusto.com agrees to reimburse the customer the money paid, without charge within a maximum of 30 days.

Note that the customer can also choose a replacement product.

ARTICLE 10 - Delivery

General Rules

maisondelgusto.com is committed to deliver the goods ordered within 30 days from the order. If a product is unavailable or out of stock, customer will be informed at the earliest and may cancel the order. It may then request a replacement product or refund.

Products purchased on the Site may only be shipped to locations in the Serviced Countries. Any delivery address situated outside the Serviced Countries will be refused during the ordering process.

All claims must be sent to the address indicated in section 2. The client will check the general appearance of the packaging of the product delivered, in case of damage, he undertakes to report on the purchase order. In addition, he will inform the company maisondelgusto.com within three days by phone +377 (0) 97 97 1793 (local call cost if calling from Monaco and France). In case of non-conformity of goods delivered, the company maisondelgusto.com will exchange the product or refund the customer.

maisondelgusto.com puts everything in place to complete orders for delivery dates requested by the customer when ordering. Once an order is placed by the customer and the payment was authorized, the order is shipped the same day if the order was placed before 11am, and the business day following the validation of the order if after 11am. The selection of the delivery date desired by the customer is an indication not binding.

Shipping Rates

During the ordering of Products process, you will be requested to select a shipping method. Maison del Gusto will inform you of the shipping costs in the order of Products summary displayed on the Site before you confirm your order. This amount will be payable by you in addition to the price, including taxes, of the Products ordered.

Orders containing fresh

Fresh products require special packaging to maintain the required temperature until delivery. Thus, for all orders containing products requiring refrigeration between 0 and 4 °C, the delivery is made mandatory by express carrier.

The recipient agrees to be present during the delivery of an order containing fresh produce. In fact, maisondelgusto.com can’t be held responsible if the cold chain was broken because the recipient was not present at the time of delivery.

It is for recipients to check the status of the package of the delivery with the carrier. Any discrepancy in the receipt must be reported within 48 hours to our customer services in order to initiate a refund from the carrier.

ARTICLE 11 - Personal information

For the success of the order, personal data collected will be processed by computer, the customer acknowledges having knowledge of this matter.

As such, the information may be disclosed concerning the business partners of the company with the sole aim to fulfill the order and delivery of products.
The computer processing has been declared to the CNIL on the following number: 1386970. In any case, maisondelgusto.com will not disclose the personal information of its customers to third parties for commercial purposes.

The customer has a right of access and correction with respect to any information about the files contained in the company maisondelgusto.com.

ARTICLE 12 - Applicable Law

The parties agree that these terms and conditions of sale are subject to the application of French law.

ARTICLE 13 - Settlement of disputes

In the event that a dispute should arise from this contractual relationship, the parties agree before any legal action to seek an amicable solution.
Any dispute concerning the interpretation or enforcement of these terms and conditions shall, failing agreement, shall be brought before the competent courts.

ARTICLE 14 - Force Majeure

Maison del Gusto will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under the Terms of any applicable laws, rules or regulations that is caused by events outside our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

• Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
• Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
• Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
• Impossibility of the use of public or private telecommunications networks; and

Maison del Gusto's performance under the Terms of any applicable laws, rules or regulations is deemed to be suspended for the period that the Force Majeure Event continues, and Maison del Gusto will have an extension of time for performance for the duration of that period.

ARTICLE 15 - Partial non-validity

If one or more clauses of these terms and conditions of sale were deemed illegal or invalid, such invalidity would not apply to invalidate other provisions of these conditions retain their full force and effect.

ARTICLE 16 - Evidence

These confirmations will be archived at the center of society Maison del Gusto and will be considered proof of the nature of the agreement and the date within the meaning of the Law of 13.03.2000.

What are we doing?

To help us make the Maison del Gusto website a positive place for everyone, we've been using the Web Content Accessibility Guidelines (WCAG) 2.0.
